DSP News Release: Saturday, January 31, 2009- DUI a Factor in Early Morning Crash

 

Location of Incident:  I-495 southbound at Edgemoor Road

 

Date and Time of Occurrence: Saturday, January 31, 2009, approximately 4:59 a.m.

 

Suspect(s):  Hector Dominguez, 21, of Wilmington, Delaware

 

Resume: Early this morning, Troopers were called to the area of I-495 southbound at Edgemoor Road for the report of a two vehicle crash. 

 

A 1994 Toyota sedan was traveling southbound on I-495 approaching Edgemoor Road.  The operator of this vehicle was Hector Dominguez.  He was accompanied by two passengers, Diogenes Miran of Wilmington and Stiwar Chinchilla of Philadelphia.

 

Hector allegedly fell asleep at the wheel.  He came to just prior to striking the left guardrail.  He jerked the wheel hard back to the right, cross all southbound lanes and struck the right guardrail.  With this impact, Diogenes Miran was ejected from the vehicle.  He was apparently asleep at the time.  The Toyota veered back to the left and stuck the left guardrail at which time it became disabled.

 

A 2003 Mercury Grand Marquis, operated by Kevin Duffy, 58, of Wilmington, was traveling southbound on I-495 and did not see the Toyota.   The Mercury impacted the Toyota.

 

All parties in this crash were transported from the scene to area hospitals.  The most serious is Diogenes Miran. He is currently at Christiana Hospital is serious but stable condition.  The other persons involved sustained non-life threatening injuries.

 

Alcohol is a factor in this crash on the part of Hector Dominguez. Upon his release from the hospital he will be formally charged with DUI, Driving without a License, Vehicular Assault 1st (felony) and Vehicular Assault 2nd (misdemeanor). 

 

Traffic was impacted for approximately two hours.
