Newark – On Tuesday, April 7th, 2009, the Delaware State Police School Resource Officer assigned to Kirk Middle School, located on West Ayer Street, investigated the assault of a 14-year old student, attending the eighth grade by the school bus driver.
The school bus driver has been identified as Mr. David V. Burns, Jr., 62, of the 200 Block of Wayne Street, Wilmington.
The investigation revealed that Mr. Burns was operating the school bus owned by Advanced Student Transportation, on its normal route following the conclusion of the school day. The student who was seated in the rear of the school bus made a statement targeted at Mr. Burns’ driving. A verbal exchange ensued at which time Mr. Burns’ punched the student in the face. The student exited the bus and was transported by his family for treatment of non-life threatening injuries.
Mr. Burns was formally charged on Wednesday, April 8th, at Delaware State Police Troop 2 for one count of Assault 3rd Degree (Misdemeanor). Mr. Burns was arraigned and issued a $250.00 unsecure bond with a no contact order pending a later trial date.
